ErisX’s Incentive Program (the “Incentive Program”), allows users ( “User” or “Users”) to receive benefits in the form of incentives (“User Incentive” or “User Incentives”).
By participating in ErisX’s Incentive Program, you indicate your acknowledgement and acceptance to Erisx’s Terms of Use. In addition to the Terms of Use, your participation in ErisX’s Incentive Program is governed by Eris Clearing LLC Rulebook and Eris Exchange LLC Rulebook (collectively the “ErisX Rulebooks”), the ErisX Privacy Policy and any ErisX Membership Agreement that you may have entered into, all as may be amended from time to time. The ErisX’s Rulebooks and any ErisX Membership Agreement to which you are a party shall supersede any conflicting terms contained in this ErisX’s Incentive Program.
Eligibility
Upon a new Member opening a new account will qualify for fee-free trading for 30 calendar days from the date the account was opened. The following are not eligible for this incentive program: 1) Entities and IRA accounts; 2) Any new account with the same tax ID as current or previous Member; and 3) Any Member that initiates an ACH deposit that results in an ACH return.
User Incentives
If a User successfully completes the eligibility requirements as described in this section, the User will qualify to receive User Incentives. User Incentives may include offers for gift cards, cash funds, physical goods, access to live or online events, cryptocurrencies, or commission-free trades on ErisX. The scope, variety, type, or amount of User Incentives may change and vary by promotion and will be disclosed in promotional materials. User Incentives may be delivered by physical mail or electronically to the registered emails or the Member accounts of Users. ErisX employees are not eligible to receive User Incentives.
To meet the eligibility requirement a User must open a new ErisX Member account. The following are NOT eligible to receive this incentive program:
Promotions offered through the Incentive Program are not valid with any other offers. Except as required by law, User Incentives that are not cash cannot be transferred for value or redeemed for cash. The Incentive Program is available only to U.S. residents. User Incentives are void where prohibited. Unless otherwise specified, third parties, including those whose names may be associated with certain User Incentives, are not sponsors of the User Program or any other ErisX promotion or offer.
Additional User Program terms
Using an ad blocker may adversely affect ErisX’s ability to determine account eligibility for the Incentive Program. Final determination of eligibility for promotions offered by the Incentive Program will be at the sole discretion of ErisX.
ErisX reserves the right to terminate any promotions associated with the Incentive Program at any time and to refuse or recover any User Incentive if ErisX determines that the User Incentives were obtained under wrongful or fraudulent circumstances, that inaccurate or incomplete information was provided by the User in opening a Member account, that any rules or regulations have been or would be violated, or that any Terms of Use have been violated. ErisX reserves the right to review and investigate incentive activities and suspend Member accounts or modify incentives at ErisX’s sole discretion.
ErisX may update the terms of the Incentive Program at any time without prior notice. If ErisX modifies the terms of the Incentive Program, it will post the modification on ErisX’s website, which will become effective upon posting. Continued participation in the Incentive Program after any modification will constitute consent to such modification.
